There will be a lot of critics about how Yahoo is handling this whole thing, but in the end, if it works, they were brilliant. It reminds me of "plan b" on the old (is 7 years old?) television show, "The Practice". When you can't prove your case, throw out as much dirt as possible on other people to confuse the jury.
In this case, I think we may see Yahoo coming out of this smelling better on the other end.
